Important Points to Notice

According to the Companies Act, 2013, it is mandatory to ensure that the following requirements are met without fail:

Two Directors:

  • A private limited company must have at least two directors, with a maximum limit of fifteen. One of the company’s directors must be a resident of India.

Unique Name:

  • The name of your private limited company must be unique and should not match any existing companies or trademarks in India.

Minimum Capital Contribution:

  • There is no set minimum capital amount for a private limited company, however, it should have an authorized capital of at least ₹1 lakh.

Registered Office:

  • The registered office of a private limited company does not have to be a commercial space. Even a rented home can be the registered office, as long as a NOC is obtained from the landlord.

Who Is Required to Apply for FSSAI License?

All food business operators (FBOs) are required to obtain FSSAI registration or license, regardless of their size or type of operation. This includes everyone from individual hawkers and home vendors to large food chains, whether they operate online or offline and whether they are involved in the local or international import/export of food products. Depending on the size and scope of their operations, FBOs must obtain one of three types of registration/license. If your business involves any of the following activities – procurement, manufacture, distribution, processing, packaging, storage, or selling of food substances – then obtaining an FSSAI food license is mandatory. Essentially, any individual or company that deals with food products from farm to plate is required to obtain the FSSAI food license.

Documents Required for FSSAI Registration

Based on the different types of registration and the food business that you are running, you have to submit different documents required for FSSAI Registration.

FSSAI Registration

  • Authorised person’s passport-sizes photograph [self-attested]
  • Authorised person’s Aadhar card front and back [self-attested]
  • Address proof of the business premises [rental agreement/previous month’s electricity bill/NOC from landlord]
  • Declaration signed by the authorised person.

State & Central License

  • Passport-sized photograph of the directors/partners/proprietor
  • Identity proof of directors/partners/proprietor [Aadhar and PAN Card]
  • Address proof of the business premises [rental agreement/previous month’s electricity bill/NOC from landlord]
  • Photograph of the premises [8-9 photos]
  • Blueprint of the premises
  • List of food products on the company letterhead [with seal and signature]
  • List of machines (if any) on the company’s paper [with seal and signature].

Manufacturing Units

Including the documents required for FoSCoS FSSAI Registration, manufacturing units have to submit the following documents as well:

  • The blueprint of the warehouse, plant, etc.
  • A list of all machinery
  • Report of a water test
  • List of all food categories

Types of Registration

According to the FSSAI Act, 2006 all food businesses are required to be registered/licensed under the following 3 categories:

Apart from this the following are also eligible for a food license

  • Any FBO with a maximum annual turnover of ₹12 lakh
    Food product retailer
  • Someone who manufactures or sells food products on their own
  • The person operating the makeshift stand sells food
  • Any person, excluding a caterer, who serves meals during a religious or social event.
  • Small-scale or home-based businesses engaged in the food industry

Yes, you do. You need a central license registered from the address in the import export code.

For a basic FSSAI registration, it takes 15-20 days from the day the application is filed. For state and central license, it may take up to 35-40 days to get your license.

All food products, including packaged, bottled, or canned food items, as well as food businesses such as restaurants, food trucks, caterers, and food processors, need an FSSAI license.

The registered office of your company will need a central FSSAI Registration FSSAI license registration. Your manufacturing units will also need individual state licenses for each state they’re in.

It is mandatory to apply for FSSAI license renewal 30 days before the expiry of the existing food & safety license. Non-renewal of food & safety license can fetch a fine of ₹100 per day until the renewal is done.

Yes, it is mandatory to mention the FSSAI license or registration number on the food product label as well as on the invoice of the food business.

Yes, if you are running a home-based food business, you need to obtain an FSSAI registration or license depending on your annual turnover and the scale of your business.

Small-scale food businesses with an annual turnover of up to ₹12 lakhs, or food businesses that handle or manufacture food only for personal consumption, or religious and charitable institutions providing food as part of their activities are exempted from FSSAI registration.
